Using Cell Phone while Driving - Primary Offense
The State of New Jersey has just made driving while using a cell phone a primary offense (effective March 1 )
This means that police can now pull you over solely because you are talking on the phone.
This also includes text messaging.
Currently - they can only fine you on cell phone talking as a secondary offense - they have to pull you over for a moving violation or such first.
A conviction or guilty plea to this offense will be considered as a conviction/plea for "unsafe driving".
While this is a no-point violation ... it carries a hefty fine ...
.... it carries a $250.00 surcharge meaning that this ticket will cost anywhere from $380.00 - $439.00 for the first offense!

It is about time! It is poor and reckless to be using your cell phone while driving. I've done it and can say it is dangerous, no matter how great of a driver one is - this is poor judgement. It can take a second of attention off the road to have an accident.
Today I use a handless voice activated phone if I need to use it.
